2. Purpose of the Privacy Policy

The purpose of this privacy policy is to inform about the rules governing the processing of personal data provided to haddock APP INC (SUCURSAL EN ESPAÑA) (hereinafter, haddock) through the website https://www.haddock.app (hereinafter "The Web"). 

Through this Privacy Policy our intention is to inform users about the collection and processing of personal data carried out by the person responsible for the Web, the purposes for which we use the data and the ways in which such data is managed, in strict compliance with the principle of transparency under the Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights ("LOPDGDD"), as well as the provisions of Regulation (EU) 2016/679 of 27 April, on the protection of natural persons with regard to the processing of personal data and the free movement of such data ("GDPR").  

For these purposes, the controller of the processing of personal data is HADDOCK and the contact details are set out in the Identification of the controller section of this Privacy Policy.

3. Purpose of the processing of personal data

The purpose of the data provided to HADDOCK, is to:  

• Manage communications received via email or contact form;
• To manage the personnel selection process for the Group's companies and the relationship with candidates for employment;
• To send information to the user by any means, including e-mail and/or equivalent means, about appropriate and personalized services that you request at any given time; 
• To keep you informed, by any means of electronic communication, of those offers, news and commercial promotions of third parties, including the analysis and profiling and, in general, the performance of commercial, promotional and/or marketing actions related to suppliers with whom HADDOCK maintains some collaboration, in order to offer you their products or services and make commercial offers, provided that you have marked the legal check authorizing the sending of such commercial communications.
  
• Those activities that are part of the corporate purpose of the data controller.

In any case, the legal basis for the processing of your personal data will be the legitimate interest of the controller, as well as, where appropriate, the consent given by the user for the processing of your personal data for the purposes indicated above.

We also collect anonymous, non-identified or aggregated information in order to improve the service we offer, such as demographic or statistical data for any purpose. For the purposes of data protection regulations, please note that none of this data can be linked to the user in any way or reveal, directly or indirectly, the user's identity. 

4. Consent of the user

By submitting data through your registration on our forms, through the use of e-mail messages or otherwise, you voluntarily provide us with your information. Such information may include your name, comments, opinions, e-mail address or telephone number.

The User guarantees that the personal data provided to HADDOCK are truthful and is responsible for communicating to HADDOCK any changes thereto, being responsible for any false or inaccurate information provided and the damages caused to HADDOCK.

5. Transfer of data

In order to fulfill the purposes outlined in this Privacy Policy, it is necessary for us to share your personal data to entities belonging to the business group of which HADDOCK is a part, as well as to third party entities (recipients) in the event that:

• You have provided your explicit consent for one or more specific purposes pursuant to Art. 6.1.a) of the GDPR.
• The disclosure according to art. 6.1.f) of the GDPR is necessary for the assertion, exercise or defense of legal claims.
  
• For the case where there is a legal obligation for disclosure under Art. 6.1.c) of the GDPR.
• Is legally permissible and necessary to fulfill contractual obligations under art. 6.1.b) of the GDPR.

In cases where HADDOCK engages the services of third parties, your personal data may be processed by a processor.

There will be no transfer of your personal data for purposes other than those listed above.

Without prejudice to the foregoing, we inform that the referred entities are located in the European Economic Area or, failing that, have taken measures to treat personal data under a secure level of data protection and ensuring the confidentiality of the same.

It is also reported that HADDOCK will share your company data and personal information with the entity STRIPE for the purpose of properly managing the payment by the user of the contracted services. 

The payment process is carried out, in any case, in an encrypted manner using the highest security standards used by this entity, and no third party can have access to the data sent by users through the payment gateway.

Likewise, you can exercise your data protection rights (access, rectification, deletion, etc.) before STRIPE by sending an e-mail to privacy@stripe.com.   

6. User's rights

The User may revoke the consent given and exercise their right of access, rectification, cancellation and opposition, portability and suppression to the processing of their personal data, under the terms and conditions provided in the current regulations on the protection of personal data.

7. Retention of your data

HADDOCK will only keep and process Users' data for as long as the purposes for which they have been collected continue and, in any case, until the expiration of the legally established deadlines.

The processing of data for the sending of informative communications will be carried out as long as the User does not revoke his/her consent and as long as the purposes for which such personal data have been collected remain unchanged.

Subsequently, the personal data will be blocked and will remain at the exclusive disposal of judges and courts, the Public Prosecutor's Office or the competent authorities for the enforcement of possible liabilities arising from the processing, during the period of limitation of the same. Once this period has expired, HADDOCK will proceed to delete the data. 
 

8. We also receive technical information when you use our services

In the event that the changes are of greater importance, we will notify you in the most prominent way or request your consent, as specified by law.

11. Applicable Law and Jurisdiction

This Web Site and the conditions contained in this Privacy Policy are governed by Spanish law. For any litigious question or conflict derived from or related to the access and use of the Website, or the interpretation and fulfillment of the aforementioned conditions, the parties submit to the jurisdiction and competence of the Courts and Tribunals of the city of Barcelona.
